Rental and Payment Terms.

  • The renter must have a valid driver's license and at least 1 year of driving experience.
  • Foreigners must have a valid International Driving Permit.
  • The renter must present a valid ID card; foreigners must present a temporary residence permit; and guests and tourists must present their passports.
  • The renter must be between 21 and 75 years of age. Otherwise, the car will be provided with a driver.

Lessor's responsibilities:

  1. Provide mandatory insurance for the provided vehicle.
  2. Arrange routine maintenance of the vehicle during normal wear and tear. In the event of tire damage due to normal wear and tear, they will be replaced free of charge.
  3. Register the vehicle and verify the validity of its documents.
  4. Ensure that all drivers operating the vehicle possess a valid driver's license recognized in Azerbaijan.
  5. The Lessor is not responsible for the loss or damage of the Lessee's belongings, thereby releasing the Lessor from liability for all accidents, claims, and damages arising from such loss or damage.
  6. The identity of the "Lessee"—the person who signed the agreement (the driver)—has been established by the "Lessee," and their legal capacity and authority have been verified.
  7. No foreign, illegal, or additional items were found upon delivery of the vehicle to the "Lessee."

Responsibilities of the "Lessee":

  1. Provide the vehicle with fuel.
  2. Unless otherwise specified in the document, use the vehicle only within Azerbaijan.
  3. Pay the service fee in advance. If payment of the service fee is delayed for more than 1 day, the Lessee has the right to request the return of the vehicle.
  4. In the event of an accident, the relevant government agency, insurance company, and service provider must be immediately notified, and the documents required for compensation from the police must be obtained. If these documents cannot be obtained, the client will be liable for any damage caused.
  5. Deliver the vehicle to a service station in a timely manner.
  6. Ensure that the tire pressure is correct and that all fluids (oil, water, etc.) are at the proper levels, and pay for any damage resulting from failure to comply with these requirements.
  7. Do not use the vehicle for any other types of service, rallies, or sports competitions, or carry cargo exceeding the permitted weight.
  8. The vehicle must be returned within the time period specified in the document and in the same condition in which it was delivered to the client. The vehicle has been imported from abroad and must be clean inside. The client will pay for repair costs based on the invoice provided by the service provider. The period during which the vehicle remains at the service station is included in the servicing period.
  9. During the rental period, the vehicle may be driven by another person named in the agreement, and this person must comply with the terms and conditions specified in the clauses of the agreement. The lessee is responsible for ensuring that the other person authorized to drive the vehicle complies with all terms and conditions specified in the agreement.
  10. The lessee is obliged to comply with traffic regulations and applicable laws. The lessee or the driver of the vehicle cannot claim ignorance of this responsibility. The lessee is responsible for fines and costs incurred as a result of violating these requirements.
  11. This agreement may be terminated by either party upon the expiration of ______ days from the date of notice.
  12. The "lessee" is fully responsible for traffic accidents, violations, administrative offenses, and crimes committed by the "lessee" for transferring the vehicle to other persons who do not have a driver's license and whose names are not specified in the agreement. The Lessor shall bear no liability during the rental period.
  13. In the event of any unlawful acts, force majeure circumstances, or accidents during the rental period, the Lessee is obligated to provide relevant information and documents regarding the event to law enforcement, government, and insurance agencies.
  14. In the event of damage to the vehicle as a result of a traffic accident, the Lessee is obligated to immediately pay 50% (fifty percent) of the rental fee for each day of the vehicle's rental until it is fully repaired by the traffic police, the relevant law enforcement agencies, or the appropriate service. If the Client selects the "Full Casco" plan, clause 14 of the Agreement becomes invalid.
  15. In the event of any malfunctions due to the Lessor's fault during the vehicle rental period, the Lessee is obligated to notify the Lessor within 1 (one) hour of the discovery of the malfunction. Otherwise, the Lessor's claim will be considered unfounded, and the malfunction will be repaired at the Lessor's expense.
  16. In the event of the Lessor's violation of any clause of the Agreement or failure to fulfill its obligations, the Lessor will defend its rights in court. The Lessor will pay all legal costs.
  17. The Lessee has the right to drive the vehicle within districts or towns in one direction for 3 days. The daily limit is 200 (two hundred) km. If the limit is exceeded, the Lessee is obligated to pay the Lessor 0.20 AZN for each excess or, in the event of a violation of the terms, the Lessor has the right to demand the return of the vehicle, regardless of the remaining rental period. If the agreement does not specify a mileage limit, Section 17 of the Agreement is considered null and void.
  18. The Lessee is prohibited from using the vehicle for hunting, off-road driving, or similar purposes.
  19. The Lessee must not exceed the maximum speed limit (120 km/h) while renting the vehicle. All technical or mechanical malfunctions of the vehicle resulting from speeding are borne by the Lessor. The Lessee has the right to demand the return of the vehicle and not to refund the payment after __ warnings from the Lessor regarding speeding or violation of any clause of the Agreement.
  20. If disputes are not resolved by agreement of the parties, they shall be resolved by the courts of the Republic of Azerbaijan at the place of performance of the contract. The place of performance of the contract shall be the Lessor's legal address.
